The American banking watchdog sets a strict ultimatum for the crypto industry. The Office of the Comptroller of the Currency (OCC) has officially published the final rule implementing the GENIUS Act. From now on, stablecoin issuers face a deadline set at January 18, 2027. After this date, any non-compliant entity or entity incapable of guaranteeing 100% backing will be banned from the American market.

In brief
- The OCC implements the implementing decrees of the GENIUS Act for the entire American banking system.
- Stablecoin issuers have until January 18, 2027 to comply, or face a complete ban on operating in the USA.
- Required to cover each crypto token with real cash or US Treasury bonds, supported by regular audits.
- Stablecoin reserves will be protected to reimburse crypto users as an absolute priority.
Stablecoin issuers banned in the United States from 2027 for non-compliance
The stablecoin industry, which represents a major pillar of the crypto market with more than $270 billion in capitalization, is entering an accelerated phase of adjustment. With the publication of the final rules of the GENIUS Act by the OCC, the American legal framework no longer leaves any room for ambiguity.
To continue operating in the United States or maintain partnerships with traditional financial institutions, stablecoin issuers will need to obtain approved issuer status (Permitted Payment Stablecoin Issuer). The OCC was very clear. Companies that do not meet all approval criteria before January 18, 2027 will be subject to a strict ban on issuance and circulation on the American market.
| Final Rule Requirement (OCC) | Obligation for the Issuer | Sanction / Impact for the Crypto Ecosystem |
| Banking approval (PPSI) | Formal registration with the OCC or Fed | Immediate ban on operating in the USA |
| 100% guaranteed reserves | Exclusive backing in cash and US Treasury bills | Withdrawal of license and freezing of tokens |
| Priority in case of bankruptcy | Legal segregation of funds for the benefit of clients | Administrative and criminal sanctions |
| Transparency and governance | Independent third-party audits and certified monthly reports | Exclusion of regulated crypto exchange platforms |
Stablecoin: the end of opacity in the crypto market
In order to avoid the risks of financial destabilization or bank panic (bank run), the GENIUS Act rule promulgated by the OCC prohibits the use of risky assets, private debt or unsecured obligations in stablecoin reserves. As said Jonathan V. Gouldacting head of the OCC.
The final rule published today provides a clear and practical framework for payment stablecoin innovation, with strict requirements for reserve backing, redemption and risk management.
Each digital dollar must therefore be backed 100% by real bank liquidity or short-term US Treasury bills. Furthermore, the law reinvents the security of crypto users. From now on, in the event of liquidation or bankruptcy of the issuer, the entirety of the reserves will be legally protected to provide absolute priority to token holders, before banks and creditors.
The GENIUS Act forces massive consolidation of the ecosystem
This OCC regulatory offensive is part of Washington’s desire to establish the supremacy of the dollar in the digital age while cleaning up the crypto market. By setting extremely high barriers to entry, the United States is triggering a decisive countdown for issuers.
Stablecoin giants like Tether and Circle have more than a few months (until January 18, 2027) to adapt their infrastructure and governance. By 2027, this strict compliance requirement is expected to cause a vast restructuring of the market, eliminating opaque projects in favor of players capable of offering first-class bank guarantees.
By imposing mandatory compliance with the requirements of the GENIUS Act before 2027 under penalty of ban in the USA, the OCC sets the rules for a stablecoin market now backed by traditional banking standards. Do you think this threat of a ban will force all major issuers in the crypto market to comply with American requirements before 2027?
