The tense crypto regulatory landscape in several countries

As cryptocurrency exchanges experience meteoric growth, regulators around the world are sharpening their weapons to regulate this volatile sector. At the heart of this regulatory storm is Binance, the world’s largest cryptocurrency exchange.

Recently, the company had to review its strategies in several countries, notably in Australia, Canada and the Netherlands and Germany. In France, the situation of Binance is also complex. The company is under judicial investigation for alleged breaches of its legal obligations.

To better understand the situation and the challenges facing Binance, we spoke with David Prinçay, CEO of Binance France.

You are CEO of Binance France, what is your view on French regulation in terms of crypto?

France established a clear regulatory framework very early on, which favored the development of the ecosystem and allowed previously established players like Binance to work with the regulator. This showed, in 2022, how far ahead French regulation is, particularly compared to our European neighbors.

We are almost in 2024, it is strategic that the French authority sets the next milestone well before the application of MiCa, as it was able to do to stay ahead, there is still a lot of work to be done.

Binance: In the eye of the regulatory storm

Amid intensifying regulations, how does Binance plan to adjust its strategy to deal with growing regulatory pressures in different countries?

Crypto has grown at an unprecedented rate. And our sector must evolve to better protect users. For our part, we consider that a regulated ecosystem is a safer ecosystem for our users.

This is why, over the past six years, we have invested heavily in a robust compliance program which incorporates sophisticated anti-money laundering principles and tools used by traditional financial institutions to detect and address suspicious activity. And we continually strive to evolve and ensure regulatory compliance and account holder protection.

Fraud and cyberattack in the crypto ecosystem

The crypto ecosystem is riddled with malicious individuals seeking by all means to deceive users, whether they are novices or simply careless. These scammers use varied and often ingenious techniques.

Cyberattacks targeting platforms in order to capture cryptocurrencies are unfortunately common. Very often, these ill-gotten assets are then routed to other exchange platforms to be liquidated. In addition to regulatory issues, we discussed the subject of cybersecurity with Mr. Prinçay.

We often talk about fraud in the blockchain ecosystem: what are you doing to fight against it?

First of all we work on scenarios ; Such behavior observed on such transactions potentially signals fraudulent use. And in this case, we are truly talking about criminal activity. This is for example the case when we observe people who cut their payments, with small amounts scattered here and there.

Afterwards, we have tools that allow funds to be traced on the blockchain. So if we see that certain assets are linked to the 1st degree or 2nd degree to portfolios suspected of criminal activity, this is included in our tools and we can also consider them as suspicious activities.

These tools, by design, surpass those used in the banking sector. At Binance France, we also have among our teams people from the police services, who have succeeded in tracing funds in situations which would have been insurmountable without the transparency offered by the blockchain.

For example, on February 14, Binance and Huobi froze $1.4 million in crypto linked to the account of the North Korean group Lazarus.

In conclusion, today, what are the priorities for Binance both on the French and international market?

Our priority is to continue to maintain our financial performance in France and internationally. Our main goal remains to build the products that our community asks of us. That’s why it works.

We do everything we can to satisfy our users. It is thanks to the combined efforts of authorities and ecosystem players that we work daily to build a harmonious environment, promoting the adoption of this technology.
